this happen locally...she reported him kidnapped yesterday.. and today she is charged with murder..5 years old..... this isnt all that far from me....awful people in this world

I guess parents don't want to believe their child is that f-cked up. Unfortunately, denial can have a high price.
I some jurisdictions "first degree murder" is reserved for the killing of a correction/police officer by an incarcerated person. Second degree murder is the most serious premeditated murder charge for the general public.
Well, according to the article the mother is off in Amsterdam and the father lives somewhere in Western Mass. The murderer has bipolar but was still deemed by aunts and uncles as capable of babysitting.
This poor kid never had a chance - they need to extract his two sisters from this situation ASAP.
First Degree has some additional aggravating factors.
I think it's kind of irrelevant now as the Death Penalty has been taken off the table and both Murder I and Murder II are A I felonies (same sentencing guidelines).
