Brady Suspension - How Likely A Best Case For NYG?

Trainmaster : 7/28/2015 7:21 pm
According to ESPN:

Quote:
Brady has authorized the NFLPA to appeal his case in federal court, a source told ESPN's Jim Trotter, where he is expected to seek an injunction that would allow him to play while his case works its way through the courts. The league and Brady's representatives had engaged in settlement talks but couldn't find common ground, which wasn't a surprise.

Given NE's schedule:

Quote:
Game 4 10/11 at Dallas
Game 8 11/8 vs Wash
Game 9 11/15 at NY Giants
Game 12 12/6 vs Phil

Ideally, an initial injunction is granted prior to Game 4 allowing him to play in the week 4 game at Dallas. In a perfect world, some kind of "legal decision" is made so he misses games 8 through 11 (missing the Giants game; don't care about him missing the Washington game in New England), and Brady is back in time for Game 12 against Philly.

For our BBI lawyers, if an injunction is granted, any guesses that the process will drag out through the entire 2015 season or is there a reasonable chance his 4 game suspension is simply delayed (if the courts don't any suspension out)?

Good Question, but...

We sufficiently own 3 teams asses: Patriots, Green Bay, and 49ers, and do so in brutal heart breaking fashion. I'm not worried about we're only going to score 17 points.
He will not get the Junction you refer to

The NFL has this one by the horns. He will serve the suspension in its full 4 games.

Understood, but the issue is also "which 4 games?".

Right now, Dallas misses NE with Brady and the Giants, Eagles and Redskins have to play NE with Brady (assuming he isn't injured).

The league is giving Dallas a gift (although BB56 does point out Dallas seems to find a way to blow "gift" games).

Do you believe the injunction / court case activity will all play out prior to the start of the season?

They have a bye week four so they play Dallas week five
I'm saying

The Cowboys catch the break this year, too bad Dez couldn't catch it last year :-) Tom Brady will miss the first 4 and as much as he would like the Injunction it's really a steep uphill battle for him, now down the road, if he still pursues it in court, he may be able to get back a nice 2million dollars worth of game checks but he'd probably pay 2 million dollars to be with his guys for the first 25% of the season. Cowboys should beat a Brady-less Patriots but you never know.
I'm not an attorney, but...

I can't see this playing out for very long. Brady suing despite the revelation that he destroyed a cell phone investigators specifically asked to see (and I believe they had agreed previously that Brady's attorney would assist with showing investigators only relevant texts to protect his privacy regarding anything else not relevant to the investigation), makes the suit ridiculous. I would not be surprised if the suit were thrown our pretty quickly. Deflatgate on its own is stupid but the cover up definitely violates NFL "integrity of the game" policies.

I think he serves the whole suspension. If there is any delay, perhaps he plays the first two games, but I think Brady will be out for the Dallas game and playing (barring injury) in the game against the Giants.

What an idiot he is.
I'm not a lawyer either

but since the original violation occured in Mass., can't TB seek an injunction there?
Wherever it is, appeal case will get postponed to after Feb 2016.
