I bring this question up because of the just-in verdict in the Owen Labrie case in New Hampshire.
For those unaware, a then 18 year old student at a prep school in New Hampshire was just found guilty of several statutory sexual contact misdemeanors and one felony luring of a minor over the computer charge after having sex with a 15 year old freshman at the school. He was acquitted of the serious rape felonies. Essentially, she said she didn't consent, he said they only fooled around and didn't even have sex. It was all part of a sex competition between the senior boys at the school. You can all Google this and find out more.
Anyway, my question is this. In New Hampshire, the age of consent is 16. I think that's the right age for it. But, I always struggle with the idea of two students in the same school being unable to have sex, assuming it was consensual. We treat the 15 year old and the 18 year old the same by having them in the same school, but there is a fundamental difference in those two ages, based on the legal code. Maybe the freshman age group doesn't belong in high schools, but rather middle schools. High school students are not mature and will make terrible mistakes. This could eliminate one such potential mistake.
Should a high school student, let's say 18 years old, face statutory rape charges on one of his peers in the same school? Again, if she says no, it's a no brainer. But, this is like the Marcus Dixon case. Should high school students face the same types of charges as real adults in these sexual assault cases?

As you said an 18 year old knows what he or she is doing, a 14 or 15 year old, not so much. And why would schools determine the age of its students by whether they could legally have sex? Simple answer juniors and seniors should stay away from freshmen.

Separate the ages? IDK, but IMO the schools should do a better job of educating the youth on the possible ramifications of even a consensual act.

Actually...even if parents aren't holding their kids back, depending on what month you were born, you can be an 18 year old senior. Kids born after September are supposed to go to school one year later compared to their counterparts born before September.

Yes, and thats a problem. Many kids born after September can be promoted and succeed (I was one). But worse it sends a message that age is an issue, and now parents are holding kids back as early as February, thinking that it somehow helps. It doesn't.

Anyway.. my schooling system was weird in that our Grade School went 2nd-6th grade and then we had a Jr/Sr High School which was one building for grades 7-12. I was only 11 when I went into 7th grade (I was young for my class, my birthday is in October) and there were 18 year old Seniors in the same school. It was kind of strange. The age gap is significant on its own but because of those specific years themselves and the fact that we grow and change so much in our teens, the gap seemed especially large.
There were definitely guys in 12th grade who dipped down into 9th grade for girls. It always seemed borderline to me and was below my personal "cutoff" as I felt those girls were just a bit too young. It wasn't for me but it also wasn't really a taboo thing, either... nor was it that uncommon. Those girls wanted to hang with older guys who were just getting their licenses and could drive as much as it went the other way.
This is also going back over 10 years and even in that span, times have changed a bit.
Not every state includes this in the statute, and the difference varies in states that do (between 2 and 5 years).

I will agree though that it's become common for parents to intentionally delay their children a year in starting kindergarten. A bunch of kids in my son's kindergarten class were already 6 when school began, and a few of them turned 7 during the school year.

What does "success" in high school mean? Very little IMO. Just get though it and make your mark when you are an adult.
All that said, I still have a problem with someone being labeled a rapist and registered as a sex offender when both parties consented, regardless of age. Plus, in those situations, it is always the male who is prosecuted.

Well, since high school is really the first step in getting to where you want to be as an adult, I think success in high school does mean something. Should it be the only thing? Of course not, but it's more important than something you just "get through."
