That said, I’m assuming Barleys dad is not a bad guy, and if he fights it I’m sure he’d have a good shot with a Bronx jury.
The circumstances with Pax were very different.
1- He had a loaded gun in a club
2- he kept in his sweat pants waist band - it dropped and fired.
3- he was a rich football player, not the dad of one
4- Plax was in manhattan, not the Bronx
Because of those circumstances, there was a media storm
And mayor Bloomberg had a big up his ass about this issue and case and was very vocal about Plax needing to go to jaiil

Although same crime - was so long ago will be up to the trial
judge as to whether to even let a new jury hear that
As for the other case - “good for him”. If the cops were not black here - race will be a factor.

You have a convicted felon with an unregistered and loaded weapon in an unregistered vehicle with non matching plates that crossed state lines.

You only need probably cause to arrest and it does sounds like there was reason to stop the vehicle (even if they didn’t know til after they would likely lie)

To rebut this presumption, you have to show that your control over the area in the car where the gun was found was not such as to give you the ability to use, or dispose of, the gun.
While it's possible the senior Barkley will evade this charge, "It's my wife's (or whoever's) gun" is not a get out of jail free card.

My 'feels' lean more towards the side of the victims of gun violence. That people in my state break laws and face the consequences isn't an outcome I feel anything about.

Defenses
1. Illegal stop
2. Illegal seizure/finding of the gun
3. Car isn’t mine, I didn’t know the gun was there. It’s my wife’s gun (he’s apparently locked in on that one)
4. It’s my wife’s gun but she gave it to my family member/ he took it because we were going to a dangerous neighborhood and wanted to be able to protect ourselves
(#4 the family member is guilty of gun possession but that hopes the jury still acquits)
A gun in a car with 2 people is not a simple case, especially in the Bronx
That said, citizens of the Bronx, in general, do not like guns.

I understand your point, but I was an assistant district attorney in the Bronx and the applicable law is more nuanced your understanding here.
That’s an excellent question and will certainly be the subject of a suppression hearing. That will likely be the key of how this case will go
