Saquon's dad arrested by NYPD

The father of a Philadelphia Eagles star has been allegedly caught with a loaded gun while driving in the Bronx, according to multiple reports.

The New York Police Department discovered the weapon after pulling Alibay Barkley over during a traffic stop at the intersection of 140th Street and Third Avenue in Mott Haven, Fox News reported on Thursday night - a day after the incident.

Alibay Barkley is the father of former Giants running back Saquon Barkley, who was raised in the Bronx and played in New York for the last six seasons. Barkley Sr could now end up being charged with criminal possession of a weapon, per Fox News.

The circumstances with Pax were very different.
1- He had a loaded gun in a club
2- he kept in his sweat pants waist band - it dropped and fired.
3- he was a rich football player, not the dad of one
4- Plax was in manhattan, not the Bronx
Because of those circumstances, there was a media storm
And mayor Bloomberg had a big up his ass about this issue and case and was very vocal about Plax needing to go to jaiil

Not his first rodeo.

The elder Barkley, who lives in Pennsylvania, has a gun possession record dating back to when he was 19 years old and spent a year in jail on Rikers Island.

In 2016, he was arrested and tased for refusing to get off a bus headed to Allentown, Pa. after he was accused of not paying. He later sued the police and the bus company for discrimination, settling for $45,000 in 2018.

He'll probably take a plea, as did Plaxico. Would be risky going to a jury. The traffic stop was valid. The gun was loaded and unregistered.

And his son no longer plays for a New York team.

Seems to me, no harm, no foul, but I don't know what the NY law is these days. As for Burress, he got a plea deal of two years with an additional two years of supervised release and was released from a protective custody unit of the Oneida Correctional Facility after serving 20 months. But Plax had other issues. Non payment of NJ taxes, slamming into a car three days after his auto insurance had been cancelled for non-payment of premium, and failure to return a Chevy Avalanche after promising to appear at a promo event. Despite all this, I was always a Plax fan and remain so.

You're as responsible as everyone else for the laws in your state. In my state we don't put people in prison for simply possessing a gun. Commit a crime with it it's another story.

Carrying on now. Hope you never get caught with something your neighbors are afraid of.

According to ABC in both Philly & NYC

He was pulled over because the plates on the Corvette he was driving didn't match. The car wasn't registered. He said the gun was his wife's plus it wasn't registered in NY State. There was a family member in the car with him. Not Saquon.

You have a convicted felon with an unregistered and loaded weapon in an unregistered vehicle with non matching plates that crossed state lines.

It wasn't reported if the weapon was registered in PA Or to his wife

You only need probably cause to arrest and it does sounds like there was reason to stop the vehicle (even if they didn’t know til after they would likely lie)

Funny thing is - the vagueness of ownership of the vehicle and family member with him both give good defenses that the gun is not his. That will be his defense.

Under New York law, the presence of an illegal gun inside a car is presumptive evidence of its possession by everyone in the car. Penal Law Section 265.15.

To rebut this presumption, you have to show that your control over the area in the car where the gun was found was not such as to give you the ability to use, or dispose of, the gun.

While it's possible the senior Barkley will evade this charge, "It's my wife's (or whoever's) gun" is not a get out of jail free card.

.

Good find

Right, it doesn’t matter if it’s his wife’s gun if he “possessed”
It at the time of the traffic stop.

My take
Defenses
1. Illegal stop
2. Illegal seizure/finding of the gun
3. Car isn’t mine, I didn’t know the gun was there. It’s my wife’s gun (he’s apparently locked in on that one)
4. It’s my wife’s gun but she gave it to my family member/ he took it because we were going to a dangerous neighborhood and wanted to be able to protect ourselves
(#4 the family member is guilty of gun possession but that hopes the jury still acquits)

A gun in a car with 2 people is not a simple case, especially in the Bronx
That said, citizens of the Bronx, in general, do not like guns.
An additional thought (pure conjecture, maybe ridiculous)

If it wasn’t in the trunk where he had no access to it, which it clearly wasn’t, your point is moot. And even if it were in the trunk it cannot be loaded. Which it was. Allegedly. If it wasn’t in the trunk where he had no access to it, which it clearly wasn’t, your point is moot. And even if it were in the trunk it cannot be loaded. Which it was. Allegedly. And even saying that, none of that has anything to do with your claiming that since he said it was his wife’s gun he was good to go. Nonsense

I understand your point, but I was an assistant district attorney in the Bronx and the applicable law is more nuanced your understanding here.
If the legitimately stopped him for the covered plates

the rest of the charges about the vehicle (i.e not registered) arise during the stop; they are not cause for it. But, how do they come to know about the gun in a routine traffic stop in the first place?

That’s an excellent question and will certainly be the subject of a suppression hearing. That will likely be the key of how this case will go

Every felony becomes a misdemeanor… unless you are running for president. In that case, it works the other way around.

They impound vehicles for switched plates, unregistered, uninsured (goes hand in hand with unreg) in the Bronx?
If yes, then inventory search required with impound covers the search aspect.

I must admit, being married with young kids I’m jealous of guys who take hours playing golf. I really don’t like it.

As Ronnie Dangerfield said in Caddyshack, “golf courses and cemeteries, biggest wastes of real estate.”

Wtf? You post on this site all the time. You go golfing once and now you’re Mr. Excitement that is full of adventures and anyone that posted while you were sucking ass at golf for a few hours have no lives? I’d say the guy trying to brag that he actually did something is the loser here. Nobody else would ever feel compelled to even mention it because not one person on this site gives a shit

and watch a little white ball roll around the grass for four hours. We’ll finally have some excitement in our lives.
