NFT: Kellen Winslow Jr story is much worse then first thought

Rape, Sodomy, Kidnapping, Indecent Exposure. All on 5 different women between the ages of 54-86 done over a 3 month period. What broke the case was him getting caught by a neighbor at an 80 yr old woman's house.

He drove the women to remote locations, where he raped them, according to police.

The first victim, age 54, was attacked on March 17.

Winslow Jr. “told her if she screamed, he would murder her,” San Diego County Deputy District Attorney Dan Owens told the San Diego Union-Tribune.

Another victim, 59, was sodomized, authorities said.

In a third incident, Winslow is accused of exposing himself to a 55-year-old woman gardening in her front yard. He was charged with burglary with intent to rape of both a 71-year-old woman and the 86-year-old in the Park Encinitas trailer park.

Winslow’s family is standing by him.

“On behalf of our son and my husband, we want to reiterate our love, support and affection for him during this difficult process,” his wife, Janelle, and father, Winslow Sr., said.

its getting really sad with these stories. Obviously what he did is awful and deserves to be in jail, but when you try to rape a 71 and 86 year old, you're more than just an awful person. Obviously very sick

But this is just a serial killer type issue.

I’m sure CTE will be the defense. As I am sure repeating mild trauma to the brain can cause mental illnesses...but mental illness does not provide a pass for committing heinous crimes. Hell every criminal out there can use that defense.

I see women hitchhiking all the time. Some of them aren't so bad. More so the "Amanda Danny" type who could lose a few pounds but if I wasn't married, I'd pick them up.

Ok, maybe not 54 but I do see a bunch in their 40s. Plenty of young women walk around my neighborhood at weird hours and they're beautiful.

Serious questions: Has CTE ever been used as a defense in a legal case? Has it ever succeeded? Has any court ever recognized it?

You say you're sure it will be. On what basis are you sure? I've never heard of any defendant or lawyer arguing CTE as a defense. But I'm not a lawyer. I could be wrong.

I'm not sure what the defense would be. Insanity? Because "My client is so brain damaged that he can't stop himself from committing sex crimes" isn't going to get your guy back on the street.

I think that's exactly wrong. Mental illness does provide a "a pass for committing heinous crimes." Or at least, insanity does. Though "a pass" doesn't mean the insane person walks free. Famous example: Ed Gein killed women and made trophies of their body parts (He was the inspiration for "Psycho" and "The Texas Chainsaw Massacre.") He was found insane, spent the rest of his life in mental institutions. He wasn't put in prison, if that counts as "a pass."

Winslow could plead insanity. He might even be able to argue CTE played a part in that, but I wouldn't bet on that working or on it mitigating his punishment much. At best, an insanity plea keeps Winslow in a mental hospital instead of a prison, probably treated as "criminally insane," probably on so many meds he'll be drooling in a corner, probably for the rest of his life. Not much of a "pass" but considering what inmates do to sex offenders in prison, maybe a tiny victory.
California uses the M'Naghten rule for legal insanity

You couldn't miss a point more if you tried. Understanding why someone is a sick fuck tends to be the only way to identify early signs of being a sick fuck and staving off doing sick fuck things.

That's kind of important, no? Or I guess burying our collective heads in the sand and accepting there aren't explanations for reality is probably just as good. That will probably, totally just make things better.

I think he’s just pointing out the annoyance in armchair diagnosis of CTE every time something happens with a football player.

Is this what happened here? Who knows? But it's not unreasonable to speculate about it.

Either way, it doesn't matter much for Winslow himself. If he's guilty, he needs to be locked up.

of Law and Order SVU where a person was raping elderly women in homes for the elderly. They say these stories are fictional but maybe the writers had inside knowledge of this story.

Turns out that that guy was raping the women because he was secretly in love with his mother and was projecting his love for her onto those other women.

Anyone know what kind of relationship Winslow Jr. had with his mother growing up? I'm just saying!

As for the CTE question - it’s something to be discussed and continue to be researched, but no fucking way should that become a defense/excuse for any ex football player who commits a crime.

This guy’s been off for years...as someone posted above, plenty of other guys with CTE who aren’t raping elderly women

How hard are you trying to not comprehend what the discussion is?

No one is saying a football related injury forced anyone to do anything. Thankfully the scientific world at large does understand all kinds of genetic and environmental circumstances can contribute to the likelihood of outcomes -- and, I know this might be bananas for some to contemplate -- understanding these factors might actually help avoid awful outcomes.

You're seeming to want to draw the conclusion that if you accept that there are factors that contribute to a circumstance, that somehow relieves responsibility. Which no one is saying and I assume no one believes.
