lpdcan28 : 1/23/2020 12:51 pm
I got a letter from my pharmacy about a medicine i have been taking that was cross contaminated with another medicine. needless to say i haven't been well the last few months and have been to doctors and had many different tests. my question is has anyone had a similar experience and did you take any further action? i havent called the drug company that screwed up yet, and a i know some lawyers who i will get advice from. any info would be appreciated. thanks
Was the product generic or branded?

.

There is a theory of strict liability assuming it was done at the manufacturing plant so they would likely be liable, but fly by night generic companies are more likely to declare bankruptcy than an innovator company. In your instance showing the correlation may be difficult as well as showing any type of long term damages. Depending on the nature of the issue it could go to a mass tort or it could simply be a one time suit. Without more information tough to say.

I will say people clamor for generic medicines because they are cheaper yet there are very real quality risks associated with many of those companies and fda simply doesn’t have resources to monitor effectively all of the manufacturing sites.

that the FDA has to certify something as 100% safe when nothing is safe. I tip my hat to the pharmaceutical industry for using the FDA to legitimize themselves.

They lose a couple billion in recalls but get a golden seal of approval for 100 of billions in sales, most of which is useless.

No, they don't certify things as 100% safe. Even common aspirin can cause serious stomach bleeds. They all come with a label of side effects and possible dangers.
