It depends on how you define "high." People can drive legally drive cars after having a few drinks. The mere fact that there was small amounts of burnt marijuana in the car doesn't really mean much to me.
As for weed there just isn't enough research on "how high is high" when it comes to impairment. I suspect whenever its fully legalized there will be zero tolerance with it when driving, which makes sense to me.
Point here is that Hunt is a moron. I don't buy "its my brother's" and even if I did he's pretty dumb to not know about it before driving.

There's plenty of reasons to think Hunt (or anyone in this scenario) can be innocent, but there's way more to suggest he's guilty.

What does a drug test have to do with anything? You can fail a drug test for THC after not smoking for over a month. The drug test has zero correlation as to whether he was fit to drive.
